1. Agreement to Terms
By accessing and using FAANYA ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.
2. Use License
Permission is granted to temporarily use FAANYA for personal, non-commercial productivity tracking purposes. This is the grant of a license, not a transfer of title, and under this license you may not:
- Modify or copy the materials
- Use the materials for any commercial purpose or public display
- Attempt to reverse engineer any software contained in the Service
- Remove any copyright or proprietary notations from the materials
- Transfer the materials to another person or "mirror" the materials on any other server
3. Task and Fine System
FAANYA operates on a self-accountability system where users:
- Set their own tasks with self-determined deadlines and fine amounts
- Agree to pay the stated fine amount if they fail to complete tasks by the deadline
- Understand that 50% of all fines collected go to registered Kenyan charitable organizations
- Acknowledge that fines are non-refundable once processed
- Accept responsibility for marking tasks as complete accurately and honestly
4. Payment Processing
All payments are processed through third-party payment processors. By using FAANYA's payment features, you agree to the terms and privacy policies of these payment processors. We do not store your payment card information on our servers.
5. User Accounts
You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.
6. Charitable Contributions
FAANYA commits to donating 50% of all collected fines to registered charitable organizations in Kenya. We reserve the right to select which charities receive donations. Donation records will be made available through the charity page on our platform.
7. Disclaimer
The Service is provided "as is". FAANYA makes no warranties, expressed or implied, and hereby disclaims all warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property.
8. Limitations
In no event shall FAANYA or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the Service.
9. Privacy
Your use of FAANYA is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Service and informs users of our data collection practices.
10. Modifications to Terms
FAANYA may revise these Terms of Service at any time without notice. By using this Service, you are agreeing to be bound by the then-current version of these Terms of Service.
11. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of Kenya, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.
